Part A — General Terms

1. Introduction and Scope

These Terms and Conditions (“Terms”) govern your use of the cabinet7.com website (“Site”) and all purchases of products and services offered through the Site. The Site is operated by Super SARL, 135 Route de Bordeaux, Le Moulin de L’Abbaye, 16400 La Couronne, France (“we”, “us”, “our”). By accessing the Site or placing an order, you accept these Terms without reservation. If you do not agree, please do not use the Site.

Marketplace notice. cabinet7 is an online marketplace facilitating transactions between private sellers (and, where applicable, professional sellers) and buyers. Unless expressly stated otherwise on a product page or during checkout, the contract of sale is concluded directly between the buyer and the selling party (the “Seller”). We provide the platform, listing review, payment handling (with buyer protection), and customer service. Where we act as the seller of record for a listing, this will be clearly indicated; in that case, the contract is with Super SARL.

2. Legal Age, Eligibility, and Health Warnings

2.1 Age Restrictions

Alcohol is sold only to adults of legal drinking age. By using the Site or purchasing alcohol, you confirm you are at least 18 years old (or the applicable legal age in your country, e.g., 21 in the USA) and legally permitted to purchase alcohol. In accordance with French law (Code de la Santé Publique, L3342-1 and L3353-3), sale to minors under 18 is strictly prohibited. We may require age verification (including ID check and adult signature on delivery). Any breach may result in order cancellation and account termination.

2.2 Health and Moderation

Alcohol abuse is dangerous for health; please consume responsibly and in moderation. Pregnant women should not consume alcohol. By purchasing, you acknowledge these warnings.

2.3 Eligibility and Compliance

You may use the Site only if you can form a binding contract under your local laws. It is your responsibility to ensure access/purchase is legal in your jurisdiction and to comply with import, tax, excise, and alcohol regulations.

3. Account Registration and Site Use

3.1 Account Creation & KYC

Browsing is possible without registration, but buying or selling generally requires creating an account with accurate information (valid email, delivery address, and any required age- and identity-verification data). We and/or our payment providers may request KYC/AML checks; payouts may be suspended until verification is completed.

3.2 Accurate Information; Prohibited Use

You must provide truthful, up-to-date information and not misuse the Site (including by attempting to purchase for minors, infringing rights, uploading unlawful content, transmitting harmful code, or data mining). We may suspend or terminate access for violations.

4. Listings, Expert Review, Pricing & Product Information

Expert review (no auction). cabinet7 is a fixed‑price marketplace. Our specialists review proposed listings (incl. photos, condition, provenance) and, where appropriate, set the initial listing price or propose a price range. A listing goes live only after the Seller accepts the proposed price and terms. There are no auctions on cabinet7.

Discounting over time. Sellers may enable a controlled price‑reduction schedule (e.g., periodic discounts) directly from their dashboard. Activating discounts is the Seller’s decision; cabinet7 may cap floors to prevent obvious mispricing or fraud.

Private‑seller items. Products offered on cabinet7 are primarily private‑seller collector items. Images are provided by Sellers and are not professional studio shots. Items are sold “as seen” based on the listing photos and description.

Collector bottles; not for consumption. Vintage/collector alcohol is listed for collection purposes. Due to age/storage variability, we do not guarantee the drinkability, taste, cork integrity, or fill stability; any decision to open/consume is solely at the buyer’s risk. Listings must state fill level, capsule/cork status, tax strip/banderole where applicable, and any re‑corking or provenance notes.

Packaging and accessories. Inclusion of box/case/COA depends on the Seller’s information; review listing details carefully.

5. Prices, Taxes, and Import Duties

5.1 Displayed Prices

Prices are generally shown in Euro (€) and may be displayed optionally in other currencies for convenience. Unless stated otherwise at checkout, shipping charges are not included in the displayed price and will be added during checkout. Currency note: Any non‑EUR currency views are indicative; your card issuer/payment provider may apply its own exchange rate and fees. The charged amount will be the EUR total shown at checkout unless expressly stated otherwise.

5.2 Taxes, Excise & Import

Orders delivered within France or the EU typically include applicable VAT when due. For deliveries outside the EU (e.g., USA, UK, Switzerland), the sale may be zero‑rated for French VAT and you may be responsible for import taxes, customs duties, brokerage, or excise fees on arrival. You act as importer of record and must comply with local law.

5.3 Billing

An electronic invoice or receipt is available on request. For private sellers, invoices may not include VAT where not applicable. Where we are the seller of record, VAT is itemized whenever applicable.

6. Orders and Contract Formation

6.1 Offer and Acceptance

Your order constitutes an offer to buy. After checkout, you receive an order confirmation acknowledging receipt; the contract with the Seller is concluded when the order is confirmed for dispatch and payment is secured.

6.2 Availability

Because items are offered by private Sellers, availability is not guaranteed. If a Seller cannot deliver, we will cancel the affected item and refund you within ten (10) days of notifying you.

6.3 Fraud, Compliance, and Refusals

We and/or the Seller may refuse or cancel orders prior to dispatch in cases of suspected fraud, legal restrictions (including sanctions/export‑control issues), or obvious errors. Any amounts already paid for the cancelled items will be refunded.

7. Payment, Escrow, and Buyer Protection

7.1 Payment Methods

We accept major credit/debit cards (processed via Stripe), PayPal, and (where offered) bank transfer to our French account (Qonto). Payment must be received in full before dispatch.

7.2 Buyer Protection & Escrow Timeline

For eligible orders, your payment is received by us and held pending successful delivery. We hold funds for up to 72 hours after confirmed delivery to allow you to inspect the item (“Claim Window”). If no claim is opened within this window, payout is released to the Seller. If a claim is opened in time, we may suspend, reduce, or reverse payout until resolution.

8. Shipping and Delivery

8.1 Method and Address

Orders are shipped by the Seller or their carrier to the address you provide at checkout. Ensure the address is accurate and reachable. Pickup may be offered where legal/practical. Shipments of alcohol may be restricted or prohibited to certain jurisdictions; orders to unsupported destinations may be cancelled and refunded.

8.2 Timeframes

Sellers are expected to ship within 5 business days after we forward purchase information. Estimated transit times vary by destination.

8.3 Statutory Delivery Rights (Consumers)

For consumer orders subject to French law, the statutory maximum delivery period is 30 days from order confirmation unless you expressly agree to a longer period. If this cannot be met, you may request delivery within an additional appropriate period; failing that, you can cancel and we will refund all payments for undelivered items (including standard outbound shipping) within 14 days of cancellation.

8.4 Risk and Title

Shipments are insured by the Seller until delivery. For consumers, risk passes upon physical possession. Title passes from the Seller upon full payment and dispatch (or as otherwise required by law). For business buyers, risk may pass on handover to the carrier.

8.5 Customs

International shipments include truthful customs declarations. We cannot mark as “gift” or undervalue. You are responsible for compliance and fees in your country (including any excise).

8.6 Inspection & Damage on Delivery

On delivery, inspect the parcel. If there is visible damage (e.g., leakage), ask the courier to note the damage in writing. Notify us at claim@cabinet7.com within 48 hours with your order number, photos, and the courier’s damage note.

8.7 “Not as Described” Claims

If the item is not as described, open a claim via your account within 72 hours after delivery (see 7.2). Provide clear photos and details (fill level, seal/capsule, label, packaging).

8.8 Failed Delivery / Returns to Sender

If a parcel cannot be delivered due to incorrect address, absence, refusal, failure to pass age‑verification/adult‑signature checks, or failure to collect, it may be returned to the Seller. In such cases, you are responsible for all shipping fees (outbound and return). Upon safe return, we will refund the product price minus those shipping costs or reship after you pay the additional fee.

8.9 Partial Deliveries

Where appropriate (e.g., multiple items or different Sellers), shipments may be split; you will not be charged extra shipping for split shipments initiated by us.

9. Returns, Withdrawal, and Refunds

9.1 Statutory Right of Withdrawal (When Applicable)

The 14‑day withdrawal right under EU/French consumer law generally applies to B2C distance sales by a professional trader. Many cabinet7 listings are offered by private Sellers (C2C), for which statutory withdrawal may not apply. Where Super SARL is the seller of record or the Seller is a professional trader, the 14‑day withdrawal right applies as provided by law.

9.2 Exceptions

No withdrawal for sealed goods unsealed after delivery for health/hygiene reasons (e.g., opened bottles), perishable goods, personalized items, and other statutory exceptions. Vintage/collectible items sold by private Sellers may be excluded from statutory withdrawal where not sold by a professional.

9.3 Voluntary Returns (C2C)

For C2C listings without a legal withdrawal right, voluntary returns are at the Seller’s discretion. Contact us within 14 days; we will assist with mediation, but Sellers are not obliged to accept returns unless agreed in the listing or required by law. This does not affect your rights for damage in transit or item not as described.

10. Product Conformity, Damage, and Liability

10.1 “Sold as Seen” and Condition

Collector items may show age‑related wear. Listings must describe condition accurately (including fill level/closure). Minor cosmetic variances due to age, storage, or display do not constitute non‑conformity if disclosed or apparent in photos.

10.2 Legal Guarantees

Where a professional seller (including Super SARL) sells to a consumer, statutory guarantees apply (legal guarantee of conformity and hidden defects). For private Sellers (C2C), such statutory consumer guarantees may not apply; this does not limit remedies for fraud or misrepresentation.

10.3 Platform Liability

cabinet7 provides the platform, payment handling, and buyer‑protection flow. To the fullest extent permitted by law, we are not liable for indirect or consequential losses. Our aggregate liability related to an order will not exceed the amount you paid for that order. Nothing limits liability for death/personal injury caused by negligence, fraud, or other non‑excludable liabilities.

11. Vouchers, Promotions, and Exclusions

Unless expressly stated, vouchers, loyalty points, or promotions do not apply to private‑seller items. Any promotional rules shown on the Site at the time of the offer prevail.

12. Data Protection

Your personal data is processed according to our Privacy Policy. We use your data to operate the marketplace, fulfill orders, manage payouts, prevent fraud, and provide support.

13. Force Majeure

We are not liable for delays or failures caused by events beyond reasonable control (including natural disasters, war, strikes, carrier disruptions, or regulatory actions). If such an event prevents performance within a reasonable time, either party may cancel undelivered items for a refund.

14. Communications

Primary communication is via email or your account dashboard. Keep your contact details current. Formal notices should be sent to: Super SARL, 135 Route de Bordeaux, Le Moulin de L’Abbaye, 16400 La Couronne, France.

15. Governing Law, Jurisdiction, and Mediation

15.1 Mediation (Consumers)

In accordance with Article L.612-1 of the French Consumer Code, consumers may seek amicable resolution via mediation within one year from a written complaint. SUPER SARL has appointed SAS Médiation Solution (registration no. 16793/VM/2507) as its Consumer Mediation entity.

EU ODR platform: You may also submit a complaint via the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

The request must include your contact details, our company name/address, the registration number above, a brief description of the dispute, copy of the prior complaint, and relevant documents.

15.2 Governing Law

These Terms and any contracts through the Site are governed by French law. If you are a consumer resident in another country, you also benefit from any mandatory consumer‑protection rules of your country where they provide a higher level of protection.

15.3 Jurisdiction

If a dispute cannot be resolved amicably, proceedings may be brought in the competent courts as determined by applicable law. Consumers may typically sue in France or in their country of habitual residence where jurisdiction is provided by law. Business customers agree to the exclusive jurisdiction of the courts of Angoulême, France.

16. Protection of Minors and Sanitary Mentions

Sale of alcohol to minors is strictly forbidden. By accepting these Terms at checkout, you confirm you are of legal age. L’abus d’alcool est dangereux pour la santé, à consommer avec modération.

18. Changes to Terms

We may update these Terms from time to time (e.g., legal changes, new services). We will post the new version on the Site and update the “Last Updated” date. For material changes, we will notify active account holders where required. The version in force at the time of your order generally governs that purchase unless mandatory law requires otherwise.

19. Miscellaneous

No Waiver. Failure to enforce a provision is not a waiver. Severability. If a provision is invalid, the remainder remains effective. Assignment. You may not assign your rights without our consent; we may assign to a qualified successor. Entire Agreement. These Terms and referenced policies constitute the entire agreement regarding the Site and marketplace transactions.


Part B — Buyer Terms

B1. Binding Purchases

Orders placed at the listed price are binding. Ensure you have checked import restrictions, total costs (shipping, taxes, excise, brokerage), and address accuracy before paying.

B2. Buyer Protection & Claims

Your payment is held until delivery and for up to 72 hours thereafter. Open any “not as described” claim within this window via your account and provide evidence. If you do not open a claim in time, payout will be released to the Seller automatically.

B3. Importer of Record

You are the importer of record and responsible for compliance with local rules, including any age‑based delivery checks, excise, customs duties, and VAT.

B4. Returns

Where a professional seller sells to a consumer, the statutory 14‑day withdrawal right applies (subject to legal exceptions). For C2C sales, no statutory withdrawal right generally applies; voluntary returns are at the Seller’s discretion.

B5. Off‑platform deals prohibited

Contact tools are provided solely for the relevant transaction. Attempts to conclude or solicit transactions off‑platform to bypass fees or buyer protection are strictly prohibited (see Part D: Enforcement & Penalties).


Part C — Seller Terms

C1. Seller Registration & Status

To sell, create a seller account and truthfully declare whether you are a private or professional seller. Professional sellers must comply with applicable consumer, tax (incl. VAT), product safety, EPR/packaging, and distance‑selling rules and are responsible for correct invoicing and disclosures.

C2. Listing Submission & Expert Review

Submit accurate descriptions and clear photos. You warrant authenticity, lawful ownership, and that the item is as described. We may edit/translate descriptions for clarity, request provenance, and decline or remove listings at our discretion.

C3. Pricing & Discounts

cabinet7 sets or approves the initial listing price following expert review. By confirming the listing, you accept the price. You may activate a managed discount schedule in your dashboard; we may enforce floor prices to protect marketplace integrity.

C4. Exclusivity During Listing

While live on cabinet7, the item must not be offered elsewhere. Withdrawing a live listing without our approval may trigger penalties (see Part D).

C5. Shipping Obligations

After we notify you of buyer payment, ship within 5 business days with valid tracking; carefully pack and insure commensurate with value. You are the shipper of record and responsible for loss/damage until delivery. For over‑collected shipping fees, refund the excess to the buyer.

C6. Payouts

Payouts are released after delivery and expiry of the Claim Window, provided no open claim exists and KYC/AML checks are completed. We may suspend or reverse payouts if claims, compliance issues, or third‑party rights require it.

C7. Consumer Rights (Pro Sellers)

If you are a professional seller, statutory guarantees and the 14‑day withdrawal right (with legal exceptions) apply for EU/UK consumers. You must handle returns timely and lawfully and bear responsibilities imposed by law.

C8. Alcohol‑Specific Rules

List only sealed bottles in original containers unless explicitly allowed by category rules; disclose fill level, capsule integrity, tax strips, and any known storage history. You are responsible for legal shipment (carrier policies, destination restrictions) and for accurate customs declarations.


Part D — Safety, Enforcement & Penalties

D1. Integrity Measures

To protect users, we may suspend listings, accounts, or payouts; cancel sales; reject or remove content; or require documentation. We may audit items virtually or via test purchases; failed audits can lead to cancellation and cost recovery.

D2. Prohibition of Off‑Platform Deals

Side‑deals or attempts to circumvent fees/buyer protection are prohibited. We may suspend accounts and charge a contractual penalty of 15% of the gross order value or €1,000 (whichever is higher) per violation, plus escalation for repeated breaches.
